My Client’s Story
My client had worked hard for her employer for many years. However, after raising concerns about her workload and the lack of support from her employer in relation to her mental health, everything changed. My client was denied her owed bonus payments; excluded from correspondence and work activities; her concerns (raised via a Formal Grievance) were ignored, and she was later subjected to disingenuous disciplinary proceedings.

During our Fixed Fee Consultation, I was able to advise my client she had excellent disability discrimination claims to pursue in the Employment Tribunal. We also discussed how she would likely have a good claim of Unfair Dismissal, in the event her employer terminated her employment.

I also advised her on the possibility (and potential value) of negotiating a settlement with her employer. This being based on the strength of her position given her potential Employment Tribunal claims (as above).
To further improve my client’s position, we also discussed submitting a Subject Access Request to her employer. I advised how this may provide useful documentation and evidence from her employer to further support her claims. Following our meeting, I confirmed my advice in writing to ensure my client had a full record of our discussions.

As part of my client’s instructions, I firstly assisted in drafting and submitting her Subject Access Request to her employer. I also provided support and assistance to my client throughout her employer’s internal procedures.
On my client’s behalf, I also initiated and undertook ACAS Early Conciliation (the first step in pursuing a claim in the Employment Tribunal) to try and reach a resolution with her employer. Her employer was, unfortunatley, unwilling to engage at that time. I therefore started to draft my client’s claims, ready to submit to the Employment Tribunal.
However, before submission of my client’s claims, her employer changed their approach. After some negotiation, I was delighted to be able to agree a significant financial settlement on behalf of my client. This included a compensation payment and an agreed reference for her future employers.
