What Is A Settlement Agreement?
A Settlement Agreement is a contract between an employer and an employee which, usually, sets out terms for the employee to give up their job, their employment rights and any Employment Tribunal claims they may have in exchange for a compensatory payment from their employer.
A Settlement Agreement can be offered in various scenarios. One example is where an employer has a redundancy situation and has placed (or is considering placing) employees “at risk” of redundancy. As an alternative to progressing through a redundancy consultation process, however, an employee may be offered the opportunity to leave their employment via a Settlement Agreement. Usually, there will be a financial incentive for an employee to choose this option i.e., they will be paid more than their contractual and statutory entitlements.
If you have been offered a Settlement Agreement in the above circumstances, try not to panic. Importantly, a Settlement Agreement is completely voluntary. If you choose not to enter into a Settlement Agreement, your employment should go forward as usual.

Before any appointment, I spend time reviewing the terms of my client’s Settlement Agreement in detail. During our appointment, we then spend time discussing the following together:
- The circumstances of their situation;
- Any potential Employment Tribunal claims they would be settling if they chose to sign the Settlement Agreement;
- The overall “benefit” of their Settlement Agreement – i.e., what benefits my client would be receiving over and above what they would otherwise be entitled to if they were ordinarily made redundant by their employer;
- Each of the individual terms of the Settlement Agreement, in detail;
- The various options available moving forward, including any possible negotiations and contractual amendments.
