It is a condition of a Settlement Agreement that an employee takes independent legal advice on its terms. Here at Lincs Law Employment Solicitors, we offer a Fixed Fee service advising in respect of Settlement Agreements. I recently assisted my client with her Settlement Agreement. I was then very grateful to receive a 5-star review and very positive feedback from my client. Please read on to find out more.
My Client’s Story
My client had worked very hard for her employer for many years. However, after experiencing issues with her Line Manager, everything changed. Specifically, my client was excluded from work events and subjected to unfair disciplinary proceedings. My client then, understandably, decided to raise a Formal Grievance about the issues she was experiencing at work. For more information about how to raise a Formal Grievance, please see our website here – https://lincslaw.co.uk/blog/how-do-i-raise-a-grievance-about-work/
After my client raised her Formal Grievance, her employer approached her on a “without prejudice” basis and offered her a Settlement Agreement to leave her employment. For more information about without prejudice correspondence, please see here – https://lincslaw.co.uk/blog/what-does-without-prejudice-mean-2/
After receiving a copy of her draft Settlement Agreement, my client decided to contact us here at Lincs Law Employment Solicitors to discuss her options and the terms of the proposed Settlement Agreement.
What Is A Settlement Agreement?
A Settlement Agreement is a contract between an employer and an employee which, usually, sets out terms for the employee to give up their job, their employment rights and any Employment Tribunal claims they may have in exchange for a compensatory payment from their employer.
Importantly, a Settlement Agreement is completely voluntary. As above, it is also a condition of Settlement Agreements that an employee takes independent legal advice on its terms. For more information about this, please see our website here – https://lincslaw.co.uk/services/settlement-agreement/
How Did I Assist My Client?
As above, here at Lincs Law Employment Solicitors, we offer a Fixed Fee service advising in respect of Settlement Agreements. Please see here for more information – https://lincslaw.co.uk/fees/settlement-agreements/
Before our appointment, I spent time reviewing the terms of my client’s Settlement Agreement in detail. During our appointment, we then spent time discussing the following together:
- The circumstances of her situation;
- Any potential Employment Tribunal claims she would be settling if she chose to sign the Settlement Agreement;
- The overall “benefit” of her Settlement Agreement – i.e., what benefits my client would be receiving over and above what she would otherwise be entitled to;
- Each of the individual terms of the Settlement Agreement, in detail;
- The various options available moving forward, including my suggestions for negotiation of certain provisions in her Settlement Agreement.
Here at Lincs Law Employment Solicitors, we understand the decision to sign a Settlement Agreement is important and has potentially life changing consequences. Our meeting, as above, was therefore of unlimited duration. This provided my client with the opportunity to fully understand her options and to make an informed decision moving forward.
Following our meeting, I also confirmed my advice in writing to ensure my client had a full record of our discussions.
After receiving my advice, my client understood the strength of her legal position. As a result, I was very pleased she was able to negotiate a further enhanced settlement package with her employer. I was then on hand to assist in signing the Settlement Agreement and sending the relevant documentation to her employer.
My Client’s Review
I was delighted to help my client with her Settlement Agreement. I was also exceptionally grateful to receive a 5-star review and the following positive feedback:
“TOP TIER!!!”
“….How refreshing to find a law firm that truly means it when they say their clients are front and centre. Kate and her assistant Helen were patient, thorough, empathic and made me feel I was their No.1 priority at all times. No pressure or obligations were put on me, but choices making me feel in control of circumstances beyond my control. Highly recommended is an understatement. I wouldn’t hesitate to use Kate for any employment need in the future. What an asset she and Helen are to their firm…”
