I recently concluded an Employment Tribunal claim for a client who had been forced out of their job. Claims of this nature are notoriously difficult to pursue. Read on for information about how I helped, along with my client’s lovely review.
Helping My Client
My client contacted Lincs Law Employment Solicitors for a free telephone enquiry. During the conversation with my client, I felt they had an arguable claim for Constructive Unfair Dismissal. However, their time was fast running out and so my client quickly booked in for what we term a Fixed Fee Consultation. More information about our Fixed Fee Consultation Service is available on our website at https://lincslaw.co.uk/fees/employees/
The Fixed Fee Consultation
During the Fixed Fee Consultation, I took my client’s full and detailed instructions on the background to their employment situation and reviewed the relevant employment documentation.
I identified a valid claim, that the claim had sufficient value to be pursued, and that the limitation date was fast approaching, and so urgent action was needed if my client wished to press ahead. During the consultation, we also discussed various funding options and I was able to understand that my client had the benefit of something termed legal expenses insurance.
Lodging the Claim
Following the Fixed Fee Consultation, I was instructed by my client to liaise with their insurers to seek funding of the Employment Tribunal claim. Initially the insurers refused to provide cover because they did not consider my client had sufficient prospects of success. However, I drafted a challenge to the initial decision which on review was accepted. In consequence, my client was given legal expenses funding to pursue their claim.
On behalf of my client, and with funding in place, I pursued their claim for Constructive Unfair Dismissal in the Employment Tribunal. Although initially reluctant to engage in any settlement discussions, the Respondent eventually brokered a deal which settled my client’s claim without the need for the parties to attend a final hearing. My client was delighted with the outcome and was kind enough to leave me the following review.
My Client’s Review
“…This was a very stressful and upsetting time for me. Sophie took all that stress and nervousness away…I knew I could trust her 100% to fight my claim and look out for me…if you want a team who are on your side, take all the stress and strain away from you, this is the team, absolutely outstanding service…”.
