If you have successfully applied for the MARS (Mutually Agreed Resignation Scheme) at your employment, you will be offered a MARS Settlement Agreement. This is a contract which will bind both you and your employer to its terms. Usually, the Settlement Agreement will:
- Make arrangements for your mutually agreed resignation. Specifically, when your last day of employment will be, your notice period arrangements, requirements for any outstanding holiday etc.
- Provide information about your payments. Specifically, what you will receive, how and when.
- Clearly set out any conditions for payments. Specifically, waiving employment rights and claims, any restrictions on future employment etc.
MARS Settlement Agreement Fixed Fees
You will be required to obtain legal advice before signing the Settlement Agreement and your employer will make a contribution towards your fees for doing so.

What Is Included With Your MARS Settlement Agreement Fixed Fee
The MARS Settlement Agreement fixed fee service includes your choice of a telephone, video or face to face appointment of up to 90 minutes where your Employment Solicitor will:-
- Discuss the circumstances of the MARS offer from your employer (we will ask you to provide your Contract of Employment and MARS Settlement Agreement. Please note, we would not review any other documentation as part of your MARS Settlement Agreement Fixed Fee);
- Advise you of the terms of the MARS Settlement Agreement from your employer;
- Draw to your attention any potential Employment Tribunal claims being settled; and,
- In the event you choose not to sign the MARS Settlement Agreement, provide an estimate of fees for any additional work.
- If you do decide to sign the MARS Settlement Agreement, we arrange for the return of your signed document to your employer; and,
- Confirm their advice in full and in writing so you have a comprehensive record of your discussions.
For most people, a MARS Settlement Agreement is dealt with at the first appointment and no further assistance is required. However, we take the time to discuss the workplace circumstances which led to you applying for your MARS. This is so we can advise as to the “deal” being offered.
