I recently assisted a client in respect of a Settlement Agreement. I did not consider the original Settlement Agreement accurately reflected the compensation my client was due and therefore negotiated on her behalf for a better deal. Please read on for more information about how I was able to increase my client’s compensation.
My Client’s Story
My client had found herself subject to a redundancy procedure at work. She was part way through the consultation meetings when her employer offered her a Settlement Agreement. A Settlement Agreement is a contract between an employer and employee whereby (usually) the employee will give up their employment and any claims they have in exchange for compensation.
My client contacted me to arrange an appointment to discuss the terms of the Settlement Agreement.
During our appointment, I asked my client to provide me with a background of her employment history and the redundancy process. What this background highlighted was that not only had her employer failed to follow a fair redundancy procedure but that my client had also suffered disability discrimination as part of their procedure. The redundancy procedure did not make reasonable adjustments to account for my client’s disability when applying the scoring matrix to decide which employee would be selected for redundancy.
When we compared my assessment of her potential claims against the financial incentives offered under the terms of the Settlement Agreement, it did not accurately reflect the compensation she was entitled to. I also noted that there were drafting amendments which needed to be made to the Settlement Agreement to protect my client’s position moving forward.
My client instructed me to enter into negotiations with her employer with a view to amending the Settlement Agreement but also increasing the compensation figure offered.
After a period of negotiation, her employer accepted all the drafting amendments requested and increased their offer of compensation. Once an amended Settlement Agreement had been prepared, I was able to have a final appointment with my client to go through the amended document and complete all the necessary formalities.
