My Client’s Story
My client had been struggling with her employer for several months. My client had been with her employer for many years with no problems, in fact she had an exemplary record. However, difficulties arose when my client was allocated a new Line Manager.
The new Line Manager constantly criticised my client; overburdened her with work; and, frequently changed her instructions (often at the last minute). My client had a pre-existing mental health condition and, as a consequence of the relentless pressure from her Line Manager, her health suffered. Occupational Health became involved, but my client’s Line Manager and the company ignored their recommendations.
Unable to take any more and worried about her health, our client asked her employer for a “termination package”. She was offered a Settlement Agreement.
How I Helped
My client booked in with me for an appointment to go through the Settlement Agreement. I explained to her that the agreement was an important document which would:-
- Set out the details of how her employment would come to an end;
- Terminate her employment;
- Waive and settle any employment rights and claims she may have;
- Set out details of notice and contractual payments; and,
- Set out details of her compensatory package.
I went through the background of the situation with my client. I explained that she had Employment Tribunal claims to bring against her employer; the value of such claims being significantly in excess of the payment she was being offered.
Very sensibly, my client discussed the situation with her family. They had agreed the best thing for her health and their family life was to end her employment. However, following our discussions, she was not happy with the compensation offered and I was instructed to renegotiate the Settlement Agreement with her employer.
After some letters and emails were exchanged, we were swiftly able to agree a new package with over four times the original compensation offered.
My Client’s Review
My client was delighted with the outcome. This had been a very difficult time for her and her family. The relief that she was leaving her employer and had a financial “cushion” in the bank was obvious. She very kindly had this to say:
