What is a Settlement Agreement?
A Settlement Agreement is a contract between an employer and an employee which, usually, sets out terms for the employee to give up their job, their employment rights and any Employment Tribunal claims they may have in exchange for a compensatory payment from their employer.
Such agreements are offered by employers for many different reasons; and accepted by employees for many reasons more. Sometimes the offer follows negotiation of a dispute, sometimes it is to speed up a restructure of the company, sometimes it is simply an amicable parting of the ways.

My Client’s Story
After going through a redundancy consultation process at work, my client was successful in avoiding her redundancy by (successfully) applying for an alternative position within the company. My client worked hard within this new role. However, after some time, she felt the role was not right for her personally. Without prejudice discussions therefore ensued and a Settlement Agreement was offered to my client to amicably part ways.

After receiving the proposed Settlement Agreement, I was delighted my client decided to book in for a Settlement Agreement appointment with me. We offer such appointments virtually (via video or telephone) or face-to-face at our offices.
Before our appointment, I spent time reviewing the terms of my client’s Settlement Agreement in detail.
Then, during our appointment, we spent time together discussing the circumstances of her situation. I was then able to advise my client in respect of the terms of her Settlement Agreement and draw her attention to the potential Employment Tribunal claims she would be settling (if she chose to sign the Settlement Agreement). We discussed her options, and she was then able to make an informed decision as to how she wanted to proceed.
Our meeting, as above, was of unlimited duration. At Lincs Law Employment Solicitors we know that decisions about Settlement Agreements can, potentially, be life changing and so time is needed to properly consider our client’s situation. We want to ease the stress and anxiety associated with the Settlement Agreement process. As there were no time constraints, I was able to discuss my client’s circumstances in detail; undertake a full assessment of her situation; understand her objectives; and advise her fully on her position.
Following our meeting, I also confirmed my advice in writing to ensure my client had a full record of our discussions. This included confirmation of the contractual amendments I considered necessary to protect her position moving forward. This allowed my client to make an informed decision and feel confident negotiating with her employer directly.
When my client then wanted to sign her Settlement Agreement, I was on hand to promptly send the relevant documentation to her employer.
