My Client’s Story
My client initially came to see me for a Fixed Fee Consultation. This is a fixed cost appointment where a full and comprehensive assessment of a client’s situation is undertaken. During this consultation, I spent a great deal of time taking instructions from my client in relation to his employer’s proposal to dismiss them by reason of alleged redundancy.
In fairness, in the current economic climate, I could see a potential redundancy situation unfolding within my client’s workplace. That said, I could also see evidence that my client was being targeted for dismissal by reason of having asserted a statutory right. Essentially, my client believed that the reason his employer was selecting him for redundancy was due to his raising concerns about his employer breaching his (and other colleague’s) statutory employment rights.
I confirmed my advice to my client in writing and set out the options for moving forward. My client needed to act quickly and so immediately instructed me to help with all the internal procedures. This included raising a grievance about the behaviour of the employer, along with representations in the redundancy consultation process.
With my assistance, my client was able to scrutinise the employer’s position and highlight a variety of flaws in their process and attempts to make him redundant. Eventually, following negotiations with his employer, my client achieved an amicable and agreed exit. I was delighted with the feedback I received, and happy to have been able to help my client.
