My Client’s Story
My client had worked for their employer for over 30 years. Unfortunately, for a long time, my client had been made to feel uncomfortable at work. They had been subjected to lewd comments, inappropriate correspondence, and conduct that caused them to feel anxious and unwell. When my client tried to raise their concerns with their line manager, they were ignored or received veiled threats about their ongoing employment. Eventually, my client was signed off as unfit to work in consequence of the problems they were experiencing.
My client had tried to informally resolve their concerns over several years, but their attempts had failed. As such, they submitted a formal grievance detailing each incident of concern. Unfortunately, the grievance investigation report failed to address most my client’s serious worries. Additionally, there was no workable resolution offered which would allow my client to return to duties.
At this point my client contacted me and I provided a detailed written advice through our fixed fee consultation service. I gave my client advice on their potential claims and their value, as well as setting out the immediate next steps that were required. Following receipt of my advice, my client instructed me to draft a grievance appeal on their behalf. I was also instructed to engage in without prejudice communications with the employer to seek an agreed departure on the most beneficial terms possible.
After initially refusing to engage in meaningful settlement discussions, I was able to negotiate a Settlement Agreement for my client. My client was delighted to leave the unhappy situation with their employer and look at fresh opportunities in the new year.
