My Client’s Story
In December 2022, I spoke to my client for the first time. They had been employed with a Company for several years and for the most part they had enjoyed their employment. There had never been any concerns raised about them or their performance.
In 2022, the global market took a negative turn which impacted my client’s employer. There was a reduction of work and the department felt much quieter. However, my client continued to work hard and keep busy.
In December 2022, they attended their appraisal. Shockingly, in this review their overall score was significantly lower than before, and it was communicated that there were now concerns with their performance. The Company intended to invoke the Capability Procedure and place them on a Performance Improvement Plan (PIP).
What Happened
Understandably shocked, my client no longer saw a future working for the Company. Their objective was to leave the Company. I therefore recommended we submit a Formal Grievance to secure their position and attempt to halt the PIP. By submitting the Formal Grievance we achieved this goal and no formal action was ever taken against my client. At the same time as the Formal Grievance, I submitted a settlement proposal to the Company. At first, the Company did not wish to engage in settlement negotiations. However, after several months and at conclusion of my client’s Formal Grievance, a good offer of settlement was received.
I was delighted for my client. The outcome was excellent and it allows my client time to secure (suitable) new employment. They were overjoyed.
