My Client’s Story
My client had worked for her employer for more than 20 years. Unfortunately, she was put at risk of redundancy but was offered an enhanced redundancy package subject to her signing a settlement agreement. A settlement agreement being a contract between an employer and employee whereby the employee (usually) agrees to end their employment and waive their employment rights in exchange for compensation.
How I Helped
It is important, and indeed a requirement, for employees to seek legal advice on the terms of a settlement agreement.
I discussed with my client the background to her particular situation and explained what she was entitled to receive financially if she was made redundant. I explained that if there was not a genuine redundancy situation, or her employer had not followed a fair procedure in selecting her for redundancy, or the decision to select her for redundancy was one which no reasonable employer should have made, she may be unfairly dismissed and have a claim for unfair dismissal.
Although my client was unhappy with some aspects of the redundancy process, I explained that the financial package offered to my client under the terms of the agreement was likely to be equal to, or could even exceed, any compensation she might be awarded by an Employment Tribunal for a successful unfair dismissal claim, bearing in mind litigation risk, legal costs and her duty to mitigate her losses by seeking alternative employment. On that basis my client was more than satisfied to accept her employer’s proposal.
