Another Reinstatement for Unfairly Dismissed Client

Mr X came to see me after being dismissed by his employer following allegations of poor performance, failure to follow reasonable management instructions and poor management skills. During our first meeting Mr X was very upset about his dismissal because he loved his job. He really wanted reinstatement and felt as though he had been unfairly targeted by what he referred to as one bad apple within the company. Although I felt Mr X had an excellent claim, he was naturally concerned about how much it would cost to pursue the case further.
I gave Mr X a full written advice following our first meeting which confirmed that I believed he had a strong claim. I also agreed to share my advice and his paperwork (with this consent) with his home insurers to see if they would pay his legal fees. The insurers were happy with my assessment and agreed that Mr X had a great claim for unfair dismissal. They agreed to fund the claim meaning that Mr X had nothing to pay me other than his initial fixed fee consultation.
Shortly after Mr X had insurance funding confirmed, I issued his claim in the Employment Tribunal making clear that reinstatement was his preferred outcome. After we had dealt with disclosure of documents, which is the process where both parties share all the paperwork they want to rely upon at the final hearing, the employer got in touch. They said they agreed they could have handled my client’s dismissal differently and agreed to look at having him back.
The negotiations between the parties were complex because in additional to compensation, there were technical issues to deal with such as my client’s continuity of employment, his reintegration to the working environment and his disciplinary record. However, a deal was eventually brokered that allowed my client to return to work on excellent terms and without the need to attend an Employment Tribunal hearing. My client was delighted with the outcome and couldn’t thank me enough.
