My Client’s Story
My client had worked for her employer for just under 2 years when she discovered she was pregnant. At what should have been a happy and exciting time, my client was devastated to be told within a week of reporting her pregnancy, her role was redundant. After the initial shock sank in, my client came to see me for a Fixed Fee Consultation to discuss her options.
I advised my client to raise her concerns through the employer’s grievance procedure and make clear that she considered the redundancy was a sham. My client had been singled out for redundancy (in isolation to any of her colleagues) and it was in response to notification of pregnancy.
Unfortunately, the situation could not be resolved through either the grievance procedure or ACAS Early Conciliation. As such, my client instructed me to issue proceedings in the Employment Tribunal. My client had the benefit of legal expenses insurance and so all her legal fees from the point of issuing her claim were covered by her insurance provider.
Once my client’s claims were lodged, the parties went through the initial stages of litigation including disclosure and preparing a joint bundle of documents. At this point, and despite initial reluctance on the employer’s side, a positive settlement was achieved for my client including a five-figure compensation payment and an agreed reference. This outcome avoided the need for her to attend court and allowed her to spend important time with her new baby.
