My Client’s Story
Over the last 15 years I have seen that in the days running up to Christmas and early in the New Year it can be very tempting for employee clients to accept less than ideal settlement packages to leave their employer. I fully understand this. The desire to start the New Year afresh can be extremely persuasive. However, I always remind clients that a Settlement Agreement is a legally binding contract. As such, it should never be entered into without a full consideration of all the facts. Although an employee might be told to sign a Settlement Agreement or face instant dismissal, there are usually other options to consider which can frequently result in a better outcome for employee clients.
The client I recently assisted was anxious to move on and start the New Year without the worry of his employment continuing to drag on. He was also fairly certain I would be unable to increase the payments he received. That said, I advised that I felt the deal he had been offered could and should be improved upon. Therefore, despite pressure from the employer to simply sign the Agreement, I was really pleased to have been able to improve my client’s financial situation and I was delighted to receive their 5-star review.
