Settlement Agreements
A Settlement Agreement is a contract which will bind both you and your employer to its terms. Usually, in a Settlement Agreement the employer will offer a compensation payment to an employee in exchange for that employee leaving their job, giving up their employment rights and agreeing not to bring any claims against their employer.

My Client’s Story
My client came to see me last year as they had been unexpectedly offered a Settlement Agreement. They were unaware of what a Settlement Agreement was or their legal obligation under it.
During our 90-minute fixed cost appointment we discussed their employment background and the circumstances which had led to the Settlement Agreement been offered.
We then through the Settlement Agreement discussing each clause in turn. During this time, I explained what my client’s legal obligations were as well as identifying any drafting amendments which were necessary to protect their position.
During our appointment, it became clear that my client had been treated unreasonably by their employer. They were facing a potential unfair internal process and had been offered a low settlement deal as an alternative. Understandably my client was very confused about their options.
In our appointment, I was able to reassure my client that there were options available to them, which we discussed at length. Ultimately, my client decided that they wanted to negotiate the terms of the Settlement Agreement and look to increase their financial package.
My client instructed me to engage in negotiations with their employer under an hourly rate retainer. After a short period of negotiations, I was absolutely delighted when we were able to triple the financial package offered under the Settlement Agreement. I was also able to negotiation a contribution to their legal fees.
The final stage of my assistance was to attend to the signing formalities to ensure the Settlement Agreement was fully executed and binding.
