My Client’s Story
My client had been very happy to secure their role at work, and believed they enjoyed a good relationship with their employer. Very unfortunately, and after a fairly short time, the employer told my client that things weren’t working out, and they wanted my client to leave the organisation. My client was told their departure could be achieved relatively swiftly through the employer’s internal procedures, or they could agree to a mutual ending of the employment relationship through a Settlement Agreement.
After receiving a copy of their draft Settlement Agreement, my client contacted Lincs Law Employment Solicitors to discuss their options and the terms of the proposed Settlement Agreement.
What Is A Settlement Agreement?
Very basically, a Settlement Agreement is a contract between an employer and an employee. These types of agreement tend to require the employee to resign from their employment and waive all claims relating to their employment and its termination. In exchange, the Settlement Agreement will usually provide the employee with certain benefits including compensation and perhaps a reference. It is important to note this is the basic position and Settlement Agreements can become complex with a myriad of obligations on either party.

Before our appointment, I spent time reviewing the terms of my client’s Settlement Agreement in detail. During our appointment, we then spent time discussing the following together:
- The circumstances of their situation which led to them being offered the Settlement Agreement.
- Any potential Employment Tribunal claims they would be settling if they chose to sign the Settlement Agreement.
- Each of the individual terms of the Settlement Agreement, in detail.
- The various options available moving forward, including my suggestions for amendment of certain provisions in the Settlement Agreement.
Following our meeting, I confirmed my advice in writing to ensure my client had a full record of our discussions. Thereafter, I was instructed to negotiate directly with the employer to seek a variety of important changes. Once my client was happy with the improved terms, we arranged for the Settlement Agreement to be signed off.
