My Client’s Story
My client had worked for their employer for less than 2 years and was facing imminent dismissal. During their dismissal process, without prejudice conversations took place with my client being offered a Settlement Agreement. In brief, my client was being asked not to appeal against their dismissal, or lodge any claims, in exchange for a settlement package.

During the appointment, I identified several discrimination claims under the Equality Act 2010. For claims of this nature, my client’s short service was irrelevant. The discrimination claims could be pursued without the 2 years’ service necessary for a claim of what I would term ordinary unfair dismissal.
I gave my client a full written opinion of my advice and they immediately instructed me to act on their behalf. Following my input my client’s settlement agreement was drastically amended to include a) further payment of benefits, b) a doubled ex-gratia compensation payment and c) almost full reimbursement of legal fees.
