My Client’s Story
Miss X came to see me after being refused a return to work following a period of long-term sickness absence. She was concerned her employer was failing to make the necessary reasonable adjustments that would allow her to get back to work. She was also very anxious that her employer had refused her request to take the holiday leave she had accrued whilst she had been off on long-term sick. This latter issue was fairly urgent as granting the request would have alleviated the immediate financial struggle she was facing.
How I Helped
I saw my client for an initial fixed fee consultation and advised her to raise a formal grievance in relation to the matters of concern. I also advised her to check her home insurance at this point, just to see if she had the benefit of something called “legal expenses insurance”. This insurance I advised could be used to fund her legal fees if matters were not resolved to her satisfaction.
Unfortunately matters were not resolved through the employer’s internal procedures. However, my client had notified her insurers of the issue and so they were happy to appoint me under the terms of her policy. This meant I was permitted to act on her behalf at no personal cost to my client. As a result, and to avoid any time limit issues, I lodged her claims in the Employment Tribunal.
As time moved on, the issue in relation to accrued holiday was resolved with my client receiving a significant backlog of entitlement. Unfortunately, the disability discrimination claim took longer to resolve but was ultimately settled in my client’s favour. I was happy to have helped my client and pleased to receive the following positive feedback: –
