Health and Safety Detriment Protection to be Extended to Workers

The Employment Rights Act 1996 (Protection from Detriment in Health and Safety Cases) (Amendment) Order 2021 was laid before Parliament on 1 March 2021 and is due to come into force on 31 May 2021.  If approved, it will extend the rights currently conferred under section 44(1)(d) and (e) of the Employment Rights Act 1996 not to be subjected to a detriment in certain health and safety cases to workers.

Coronavirus: Returning to work safely

As we approach our way towards the end of the Job Retention Scheme but with coronavirus cases continuing to dominate the news, I have noticed there is a growing sense of unease for employees who are due to return to work soon. The main concern is one of Health and Safety at Work and ensuring they are safe, or what their position is if they are classed as vulnerable or ‘high risk’.
