My Client’s Story

My client originally sought my advice several years ago after an ongoing medical issue caused them to suffer periods of sickness absence from work, which they feared was likely to result in their unfair dismissal. At that time, I provided detailed advice about disability discrimination and unfair dismissal, and my client was able to continue in their employment.

Moving forward, my client’s health sadly showed no signs of improvement. During what became a period of long-term sickness absence a dispute arose with the employer, and on a without prejudice basis, my client signified a wish to leave the employment relationship. In response to my client’s request, a Settlement Agreement was provided by the employer.

How Did I Assist My Client?

I then met my client and during our appointment we discussed the following issues: –

  • The circumstances of their situation.
  • The potential Employment Tribunal claims they would be settling (if they chose to sign the Settlement Agreement);
  • The overall “benefit” of the Settlement Agreement – i.e., what benefits my client would be receiving over and above what they would otherwise be entitled to.
  • Each of the individual terms of the Settlement Agreement, in detail.
  • The various options available to her moving forward.

Our meeting was very detailed, and it transpired the Settlement Agreement offered by the employer was in my view, a considerable amount lower than I assessed to be reasonable. Following the meeting, I set out my advice in writing so my client could consider how they wanted to proceed.

After reviewing my written advice, my client elected to instruct me to negotiate with the employer and seek a variety of amendments to the financial package, and other terms of the Settlement Agreement. Unfortunately, the process was not straightforward, and my client’s reasonable requests were met with resistance throughout. Eventually, after a lot of hard work, I was delighted to secure a Settlement Agreement my client was happy to sign.
