My Client’s Story
My client had been unable to teach for a long time because of their medical conditions. During their time off sick from work, they had made an application for ill health retirement on the basis they did not believe they would ever be able to return to teaching. At first instance, their application was refused but they knew their prognosis was poor and so contacted me to see if I could assist.
How Did I Assist My Client?
I provided my client with a free telephone consultation during which I established their situation was one I could advise upon. However, I explained the next step was to review the case in detail (including their current medical position and the application they had already submitted, along with the rejection documentation). My client went ahead and we met for a Fixed Fee Consultation. During the Fixed Fee Consultation, and as promised, I reviewed all the paperwork provided by my client, including the medical papers. I explained that whilst the requirements for a successful application for ill health retirement are very stringent, I did on this occasion think there was merit in submitting an appeal. This is not always advice I can give – but on this occasion, it was. I provided my client with guidance about what to include in the appeal should they wish to submit one. I also provided a cost estimate to complete that work on their behalf.
Following the Fixed Fee Consultation, my client asked me to support them by drafting their appeal which, in fact, necessitated obtaining further medical evidence. Unfortunately, and despite providing additional medical evidence, the initial appeal failed. However, the issues had been further narrowed and so after submitting a second appeal – dealing with those last issues, my client was successful and received ill health benefits at the top tier level.
