FURTHER INCREASE IN COMPENSATION AWARDS
Following a claim for Discrimination or Detriments, the Employment Tribunal can make an award of compensation to Claimants (employees) for something called hurt feelings. This type of compensation is to reflect how hurt a Claimant is by the treatment they received from the Respondent (employer).
Following a Judicial Consultation in summer 2017 the bands (or levels) of compensation for injury to feelings were significantly increased. Now, the Presidents of the Employment Tribunals in England & Wales have issued new Presidential Guidance updating the bands of awards for injury to feelings once more.
The new updated awards will come into play in relation to claims presented on or after 6 April 2018 and they will be as follows:
- a lower band of £900 to £8,600 (less serious cases);
- a middle band of £8,600 to £25,700 (cases that do not merit an award in the upper band);
- an upper band of £25,700 to £42,900 (the most serious cases),
- with the most exceptional cases capable of exceeding £42,900.
Although this guidance is not binding, Employment Tribunals must have regard to it. This further update to awards is clearly indicative of how seriously the Tribunals Service are taking claims and so it is now even more important to ensure your claim is handled by an expert.
